REGULATIONS OF THE LITHUANIAN DEPARTMENT OF STATISTICS

I. GENERAL PROVISIONS

1. The Lithuanian Department of Statistics (hereinafter referred to as "Statistics Lithuania") shall be a government agency participating in the formation of State policy in the field of the management of statistics, assigned to the Minister of Finance, and implementing it.

2. The activities of Statistics Lithuania shall be governed by the Constitution of the Republic of Lithuania (Official Gazette, 1992, No 33-1014), international agreements of the Republic of Lithuania, the legislation of the European Union, the Law on Statistics (Official Gazette, 1993, No 54-1048; 1999, No 144-3299) and other laws of the Republic of Lithuania, other legal acts adopted by the Seimas of the Republic of Lithuania, the decrees of the President of the Republic of Lithuania, the resolutions of the Government of the Republic of Lithuania, the directives of the Prime Minister of the Republic of Lithuania, these Regulations and other legal acts.

3. Statistics Lithuania shall be a budgetary institution.

4. Statistics Lithuania shall be a public legal person which shall have a bank account and a seal bearing the national emblem of Lithuania and the name of Statistics Lithuania. The address of the head office of Statistics Lithuania is: 29 Gedimino Ave., Vilnius, Republic of Lithuania.

5. Statistics Lithuania shall be maintained from the State budget of the Republic of Lithuania in accordance with the procedure laid down by legislation. Statistics Lithuania may also be resourced from other legally obtained funds.

6. The owner of Statistics Lithuania shall be the State; the rights and duties of the owner of Statistics Lithuania shall be executed by the Government of the Republic of Lithuania, which shall:

6.1. approve the Regulations of Statistics Lithuania;

6.2. decide upon the change of the head office of Statistics Lithuania;

6.3. deal with other questions assigned to its competence as an institution executing the rights and duties of the owner of Statistics Lithuania by laws and other legal acts.

7. Public information of Statistics Lithuania shall be published on the website of Statistics Lithuania (www.stat.gov.lt) and/or in other media laid down by legislation.

8. The Regulations of Statistics Lithuania shall be amended in accordance with the procedure laid down by legislation.

II. OBJECTIVES AND FUNCTIONS OF STATISTICS LITHUANIA

9. The objectives of Statistics Lithuania shall be:

9.1. to participate in the formation of State policy in the field of the management of statistics, assigned to the Minister of Finance, and to implement it;

9.2. to implement the common national policy in the field of the methodology and organisation of statistics;

10. For the purpose of fulfilling the objectives established, Statistics Lithuania shall perform the following functions:

10.1. participation in the formation of State policy in the field of the management of statistics, assigned to the Minister of Finance, and the implementation thereof:

10.1.1. preparation and submission to the Government of the Republic of Lithuania of a report on state-owned property;

10.1.2. assistance in the preparation of forecasts about the development of the Lithuanian economy;

10.1.3. preparation of forecasts about the expected population figures and composition, calculation of gross domestic product and short-term changes in inflation;

10.1.4. analysis of the economic, social, demographic and environmental changes taking place in the Republic of Lithuania; informing of State and municipal authorities and agencies, scientific institutions and the society about them;

10.1.5. complex or partial deliberation, harmonisation, revision and related target analysis of draft laws and other legal acts pertaining to the management of statistics; submission of proposals having an effect on the quality of such drafts in accordance with the procedure laid down by national legislation;

10.1.6. preparation and approval of the Work Programme of Official Statistics

10.1.7. preparation of the Work Programme of Official Statistics Implementation Report and submission thereof to the Government of the Republic of Lithuania for approval;

10.2. implementation of the common national policy in the field of the methodology and organisation of statistics;

10.2.1. establishment of statistical observation forms and modes;

10.2.2. establishment of statistical indicators and methodologies for the production thereof;

10.2.3. preparation and approval of the programmes of statistical surveys, general censuses;

10.2.4. preparation and approval of forms for statistical surveys and statistical reporting, reports, questionnaires, instructions and rules for filling them in; provision of respondents therewith;

10.2.5. collection, accumulation, analysis and summarisation of statistical data; preparation and release of information on persons' production, commercial, financial and social activities and conditions thereof;

10.2.6. preparation of statistical reviews;

10.2.7. accumulation and summarisation of statistical information on the economic, social, demographic and environmental changes taking place abroad; release of the key comparative indicators of Lithuania and foreign countries;

10.2.8. creation of a statistical information system and integration thereof into the national information infrastructure and the European Statistical System;

10.2.9. management of statistical registers and, by order of the Government of the Republic of Lithuania, other registers;

10.2.10. preparation and publication of statistical yearbooks, bulletins, other information publications; provision of information on different media;

10.2.11. provision for State and municipal authorities and agencies of statistical information under the Work Programme of Official Statistics free of charge, that not established in the Work Programme of Official Statistics – if its preparation costs are defrayed;

10.2.13. within competence, the coordination of the statistical surveys conducted by other institutions managing official statistics and registration thereof; harmonisation of statistical survey and statistical reporting forms and methodologies;

10.2.14. conclusion of agreements on the statistical domains managed, the development of methodologies and production of statistical information, information exchange and publication procedures with ministries and other institutions managing official statistics, the Bank of Lithuania;

10.2.15. implementation of statistics-related international classifications and standards;

10.2.16. summarisation and application of the experience of foreign statistical offices;

10.2.17. taking care of the development of statistical research;

10.3. conclusion of bilateral and multilateral cooperation agreements with foreign statistical offices and international statistical organisations in accordance with the procedure laid down by legislation;

10.4. participation in the activity of international statistical organisations on the improvement and development of international statistics;

10.5. implementation of organisational, technological and technical measures ensuring statistical data and information protection and confidentiality;

10.6. consideration of persons' requests, applications and complaints in accordance with the procedure laid down by legislation;

10.7. performance of other functions laid down by legislation.

III. RIGHTS OF STATISTICS LITHUANIA

11. Pursuing the objectives set in par. 9 of these Regulations and for the purpose of performing its functions, Statistics Lithuania shall have the right:

11.1. to receive information on the statistical surveys planned, which is required for the preparation of the Work Programme of Official Statistics, from State and municipal authorities and agencies according to the form and on time reasonably set by Statistics Lithuania;

11.2. to receive, free of charge, statistical data which are required for the implementation of the Work Programme of Official Statistics from respondents, State registers and information systems;

11.3. to receive statistical publications from other institutions managing official statistics for the formation of the library stock of Statistics Lithuania;

11.4. to organise the statistical observation of households; to carry out statistical surveys on the basis of respondents' voluntariness;

11.5. to organise and carry out general censuses; to involve, for that purpose, the population, if needed, in accordance with the procedure laid down by law or the Government of the Republic of Lithuania;

11.6. to organise the release of statistical information and to provide it on various media;

11.7. to provide non-confidential statistical data at the request of the persons concerned (a decision on the provision of such data shall be taken by the Director General of Statistics Lithuania);

11.8. to provide confidential statistical data for scientific purposes to scientific institutions on a contract basis; these data shall be submitted in such a way that it is impossible to directly identify respondents from them;

11.9. to check whether the statistical data submitted were calculated following the approved methodologies;

11.10. if needed, to invite experts to assess the reliability of statistical information;

11.11. to cooperate with the Lithuanian Academy of Sciences, universities, other scientific institutions;

11.12. to use State property and to manage it by the right of trust;

11.13. to perform other statistics, accounting and analysis-related work under contracts with municipal authorities and agencies, other persons;

11.14. to receive support in accordance with the procedure laid down by the Law on Charity and Sponsorship of the Republic of Lithuania (Official Gazette, 1993, No 21-506; 2000, No 61-1818);

12. Statistics Lithuania shall have other rights laid down by legislation.

IV. ORGANISATION OF ACTIVITY OF STATISTICS LITHUANIA

13. Statistics Lithuania in its activity shall follow the strategic and annual action plans prepared according to the procedure laid down by the Government of the Republic of Lithuania. The strategic action plan of Statistics Lithuania shall be approved by the Minister of Finance. The annual action plan of Statistics Lithuania shall be approved by the Director General of Statistics Lithuania, having agreed it with the Minister of Finance. The assessment of the implementation of the strategic and annual action plans shall be performed by the Internal Audit Service of Statistics Lithuania. The administrative structure of Statistics Lithuania shall be approved by the Government of the Republic of Lithuania.

14. The activity of Statistics Lithuania and its administrative divisions shall be regulated by the regulations of the administrative divisions of Statistics Lithuania, internal regulations, job descriptions of civil servants and employees working under an employment contract, approved by the Director General of Statistics Lithuania.

15. Statistics Lithuania shall be headed by Director General – a state official who, on the recommendation of the Minister of Finance, shall be appointed to office for a period of four years and dismissed from office by the Government of the Republic of Lithuania. The Director General of Statistics Lithuania may be appointed to hold office for no more than two successive terms of office. The Director General of Statistics Lithuania shall be held responsible and accountable to the Government of the Republic of Lithuania and the Minister of Finance.

16. The Director General shall supervise the administrative divisions of Statistics Lithuania directly or through deputies. Deputies of the Director General shall be directly subordinate and accountable to the Director General. Deputies of the Director General shall organise and control the work of the heads of the administrative divisions supervised by them, coordinate the activity of those divisions, perform other functions delegated by the Director General.

17. The Director General of Statistics Lithuania shall:

17.1. deal with issues within the competence of Statistics Lithuania; be personally responsible for the fulfilment of the objectives and proper performance of the functions necessary for the fulfilment thereof delegated to Statistics Lithuania;

17.2. ensure the implementation of laws, international agreements of the Republic of Lithuania, the decrees of the President, the resolutions of the Government, the directives of the Prime Minister of the Republic of Lithuania and other legal acts;

17.3. ensure the implementation of the assignments of the Government and the Prime Minister of the Republic of Lithuania;

17.4. issue orders and supervise the implementation thereof;

17.5. submit reports on the activity of Statistics Lithuania to the Government of the Republic of Lithuania in accordance with the procedure laid down by the Government of the Republic of Lithuania; submit reports on his/her activity at the request of the Government or the Prime Minister of the Republic of Lithuania;

17.6. approve the regulations of the administrative divisions of Statistics Lithuania, lists of positions of the civil servants and employees working under an employment contract of Statistics Lithuania;

17.8. in accordance with the procedure laid down by law, appoint and dismiss deputies, other civil servants and employees working under an employment contract of Statistics Lithuania, motivate and impose disciplinary punishments upon them, grant them allowances, take other personnel management-related actions laid down by legislation in relation to them;

17.10. approve the plans of the publication and presentation on different media of statistical information prepared by Statistics Lithuania;

17.11. approve the internal regulations of Statistics Lithuania;

17.12. exercise other powers granted by legislation.

18. In the absence of the Director General of Statistics Lithuania, Director General shall be deputised for by First Deputy Director General, in the absence thereof – another Deputy Director General by order of the Director General.

19. The Statistical Council, formed in accordance with the procedure laid down in the Law on Statistics of the Republic of Lithuania, shall operate at Statistics Lithuania.

20. For the consideration of specific statistical and accounting issues, expert commissions and working groups may be formed. The composition thereof shall be approved and the tasks thereof shall be set by the Director General of Statistics Lithuania.

V. INTERNAL ADMINISTRATION CONTROL OF STATISTICS LITHUANIA

21. The State (financial (legitimacy) and performance) audit of Statistics Lithuania shall be performed by the National Audit Office of Lithuania in accordance with the procedure laid down by legislation.

22. The control over the implementation of the strategic action plan of Statistics Lithuania shall be exercised by the Minister of Finance and the Director General of Statistics Lithuania.

23. The control over the implementation of the annual action plan of Statistics Lithuania shall be exercised by the Director General of Statistics Lithuania.

24. The internal audit of Statistics Lithuania shall be performed by the Internal Audit Service of Statistics Lithuania in accordance with the procedure laid down by legislation.

25. Financial control over Statistics Lithuania shall be exercised by the civil servants or employees working under an employment contract appointed by the Director General of Statistics Lithuania.

VI. FINAL PROVISIONS

26. Statistics Lithuania may be reorganised, liquidated or restructured in accordance with the procedure laid down by the Civil Code (Official Gazette, 2000, No. 74-2262), other laws and other legal acts of the Republic of Lithuania.
